Poland Constitutional Court : On Friday, demonstrators and police clashed outside the Constitutional Tribunal in Warsaw, causing Poland to confront new political turbulence. Three individuals were detained as protesters broke through a fence and hurled items at cops, while a disagreement over the court’s leadership exacerbated the crisis between Prime Minister Donald Tusk’s administration and the opposition Law and Justice (PiS) party.
Justice Minister Waldemar Żurek attempted to remove the legal immunity of Constitutional Tribunal President Bogdan Święczkowski and Vice-President Bartłomiej Sochański, causing turmoil. The minister believes the two officers should face criminal proceedings.
The dispute has widened an existing struggle over judicial appointments and the government’s efforts to reverse changes introduced under the previous PiS administration. It also prompted President Karol Nawrocki to cut short his trip to Senegal and return to Poland.
Poland Constitutional Court Dispute Triggers Street Clashes
Demonstrators protested outside the Constitutional Tribunal, claiming that the government had suspended the court’s president in an illegal manner. After some protestors broke over the perimeter gate, police deployed riot policemen to keep them out of the building.
The encounter was part of a larger debate regarding who has the ability to govern the court and whose judicial nominations are legally binding.
Nawrocki indicated that he will be returning from his scheduled trip to Senegal due to the issue. In a post on X, he stated that the president ought to be in Poland at that time.
The Constitutional Tribunal also questioned the government’s argument. According to a social media announcement, Święczkowski and Sochański remain the court’s constitutionally designated senior judges. The court also termed the activities done against it as a coup d’état.
Tusk supported his government’s stance, claiming that restoring the rule of law was a duty, regardless of the obstacles entailed. He has already committed to depoliticise the court and believes that modifications implemented under PiS must be corrected.
Opposition leaders have also sharply criticised the conflict. Former Justice Minister Zbigniew Ziobro described the government’s decision as a criminal attack on Poland’s constitutional order and encouraged citizens to oppose it.
Poland Constitutional Court Row Deepens Political Divide
The current conflict stems from years of argument about the Constitutional Tribunal. PiS took power in 2015 and chose judges to form a majority on the court, which can decide whether legislation complies with the country’s rules.
The European Court of Human Rights and the Court of Justice of the European Union previously determined that three judges elected by the PiS majority were illegally appointed because their positions had already been filled by the previous legislature.
Tusk’s efforts to undo PiS-era court modifications have encountered roadblocks. Nawrocki and his predecessor, Andrzej Duda, utilised presidential vetoes to thwart some of his efforts to reform the system.
Nawrocki has also refused to swear in five Constitutional Court judges elected by parliament since March, citing alleged issues with their appointment. Some of Tusk’s followers have chastised him for not acting quickly enough to undo previous measures.
Tusk has accused Müller Šczkowski, who was appointed tribunal president under the PiS administration, of blocking the appointment of judges chosen by the parliamentary majority.
The dispute has become more politically sensitive ahead of parliamentary elections scheduled for next year. Some observers view the move against the tribunal’s leadership as an attempt to increase Tusk’s support among voters, although this remains an interpretation.
After returning to Poland, Nawrocki faced persons at the court’s entry who had cut the gate’s chains. He was heard telling them they were not Constitutional Tribunal judges.
The controversy over judicial selections and power continues unresolved, with the government, opposition, and president taking opposing viewpoints.
