Sam Wood Bail : Sam Wood, former The Bachelor star and fitness guru, will stay in detention after the Queensland Supreme Court denied his second bail plea. Justice Patrick McCafferty concluded on Friday that Wood had failed to demonstrate that he could be freed without endangering his wife, Snezana, or other members of the community.
Wood, 46, is facing domestic assault charges stemming from an alleged altercation at a vacation property in Noosa, north of Brisbane, on October 3. He has been in detention since his original bail plea was denied by the Maroochydore Magistrates Court on October 8.
Wood will remain on remand until the criminal case is resolved, according to the most recent judgment. The court was not convinced that the proposed release procedures would mitigate the identified risks to an acceptable degree.
Sam Wood Bail Decision Follows Risk Assessment
Justice McCafferty expressed worry about the prospect of subsequent offenses, risks to the claimed victim, and potential tampering with witnesses. He found that the conditions provided by Wood’s legal team would not be sufficient to meet those concerns.
In his decision, the court stated that Wood had not demonstrated that releasing him on bond would be safe. The court also evaluated the potential threat to the welfare of the individuals concerned in the case.
Wood did not attend the court in person or via video connection.
The accusations stem from allegations that Wood pushed his wife against a wall, strangled her, and smacked her head on the floor during a reported incident in Noosa. These are still allegations, and the court’s bail judgment does not establish his guilt or innocence.
The charges involve a possible jail term of seven years, as mentioned at the hearing.
Wood’s counsel, Paula Morreau KC, recognized the gravity of the allegations but said that putting him in jail would result in a protracted term on detention before trial. She informed the court that the trial was unlikely to take place within 12 months.
Morreau further contended that Wood may spend more time in detention awaiting trial than the non-parole period he could face if convicted. She argued that a two-year sentence, with parole eligibility after one year, was more plausible than the maximum punishment.
However, the judge’s worries regarding the safety and efficacy of the suggested bail restrictions remained crucial to his ruling.
Sam Wood Bail Bid Included Move to Tasmania
Wood’s legal team requested in the second application that if freed, he reside with his father, Andrew Wood, in Tasmania. Morreau said that relocating away from his wife and their current situation would assist lessen the risk to her and the general public.
The court also learned that Wood and Snezana had essentially split. The pair met while starring on the TV show The Bachelor.
The evidence given at the court included details regarding Wood’s lifestyle, such as partying and drug and alcohol usage. The court was also informed that his relationship with his wife had been volatile.
Wood admitted to certain facets of that lifestyle, the court heard. His counsel used the planned living arrangements to buttress the claim that he may be freed with conditions.
However, the judge was not satisfied that these procedures would be sufficient to control the dangers outlined in the case. The second application was thus rejected.
The Maroochydore Magistrates Court dismissed Wood’s initial bail application on October 8. He has been in detention since the judgment.
The most recent Supreme Court judgment remands him while the matter is still pending. There was no trial date mentioned in the stated hearing facts.
